The Nevada Supreme Court in Rivero v. Rivero, 124 Nev. Adv. Op No. 84, filed October 30 2008 has changed the legal definition of “joint physical custody” to include custodial arrangements where the parents do not exercise precisely equal timeshares. The decision adopts the Missouri definition of joint physical custody, and has dramatically changed child custody and child support law in Nevada. Neil M. Mullins, Esq. of Mullins Law Firm is confident the decision, while technical, will ultimately add clarity to an otherwise cloudy distinction between primary physical custody and joint physical custody. The Court also took the time to address the child support aspects of the new custody designation. The spouse that has a little more custody time under the new joint physical designation my not like losing the primary custody designation, nor like the prospect of not receiving the full child support formula amount under NRS125.070. However the Court did create new child support calculation formula to address the new custody designation.
